CMS to Review PECOS Enrollment Process 
The Centers for Medicare & Medicaid Services (CMS) is working with providers to address concerns about enrollment in the Provider Enrollment, Chain and Ownership System (PECOS) to ensure that Medicare beneficiaries continue to receive the health care services and items they need. PECOS is the electronic system used to enroll physicians and eligible professionals into the Medicare program. As part of those efforts, CMS will, for the time being, not implement changes that would automatically reject claims based on orders, certifications, and referrals made by providers that have not yet had their applications approved by July 6, 2010. Federal law establishes a 2.2 percent update to the Medicare Physician Fee Schedule (MPFS) payment rates retroactive from June 1 through November 30, 2010.

Medicare Rate Increase 
New federal legislation, which the President is expected to sign on Friday (June 25th), will replace the 21% Medicare physician payment cut now in effect with a 2.2% increase, to be applied restroactively to claims for services provided on or after June 1st.

Medicare Rates and the US Senate 
Late Friday afternoon (6/18.10) U.S. Senators approved a $6.4 billion six-month "patch" that blocks, retroactive to June 1st, the Medicare fee cut to ODs and other Medicare physicians and other providers and provides for a 2.2% increase.

Medicare Payment-Fix Vote Defeated 
Unfortunately, efforts yesterday in the U.S. Senate to advance an 18-month Medicare physician payment fix and supplemental Medicaid funding for states as part of a tax and social program "extenders" bill (HR 4213) was defeated in a procedural vote.

News from the AOA: US Senate Postpones Medicare Fee Fix Vote  
U.S. Senate leaders shared with AOA staffers today that they plan to postpone, until early next week, a scheduled vote on a tax and spending program “extenders” package, which includes a physician group-backed plan to reverse the 21 percent cut in Medicare payments to ODs and other physicians that took effect June 1, 2010.

Lawmakers have been working to bring legislation to the floor of the U.S. House and Senate that would prevent the June 1 enactment of a massive 21 percent cut in Medicare payments to ODs and other physicians.

Timely and Urgent Medicare News 
This month CMS published an “interim final rule” implementing some of the Medicare enrollment-related provisions of health reform law (PPACA) and further discussed the provisions on a conference call that the AOA participated in. The interim final rule takes effect on July 6, 2010 and provisions will immediately burden members and Medicare patients.
